  • Did your loved one have a valid will?*
  • Do you know who are listed as the Executor/s of the Will?*
  • Who is/are the Executor/s listed on the Will? (Please add rows if there are more than one. If you arent sure of their email, please put N/A for now).*
  • In the event of no Will, the Rules of Intestacy typically determine who is the Administrator of the Estate. According to these rules, the order of priority starts with the current Spouse, followed by Children, then Parents, then Siblings and finally extended family. Based on this knowledge, would you consider yourself the Administrator?*
  • Property

    Unless jointly owned, property ownership will mean that a Grant of Probate or Letters of Administration is required to transfer that ownership or manage the sale process.

  • Refundable Accommodation Deposit (RAD)

    A RAD is often paid as a lump sum for nursing home or care accommodation. The RAD is fully refundable to the resident when they leave the provider or is returned to the resident’s estate if they pass away.

  • Did your loved one live in an aged care facility or nursing home and make financial contributions to their living arrangements?*
  • Bank Accounts

  • The total value of banks accounts can be important when dealing with your loved one's assets.

    There will be a threshold that each bank has preset to determine how they will allow you to finalise and close your loved one's bank accounts. This varies significantly between banks and will determine whether a Grant of Probate (or Letters of Administration) will be required to access and distribute the funds.
